Terms of Service

Effective date: 28 April 2025

1. Acceptance

By creating an account or buying credits, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use WhateverGPT.

2. Eligibility & Accounts

You must be 18 or older and legally able to enter contracts. Sign-in is via Google OAuth; you are responsible for keeping your Google account secure.

3. The Service

• Upload an Original Image (not stored).
• Our system sends the image and your text prompt to OpenAI's GPT-Image-1.
• We store only the Generated Image and prompt.
• We give you a non-exclusive, worldwide licence to use each Generated Image for any lawful purpose.

4. Credits, Pricing & Refunds

• Credits are prepaid digital tokens; 1 credit.
• Credits never expire while your account is active.
• Prices are in GBP, inclusive of VAT where applicable.
• Under the Consumer Contracts Regulations 2013, digital content is not subject to the 14-day cooling-off period once you start downloading/streaming. Therefore refunds are only at our discretion unless the service is faulty.
• We may change prices but will give at least 14 days' notice.

5. User Content & Ownership

You confirm you own or have lawful rights to the Original Image and that it contains no unlawful or infringing material. You retain all rights in the Original Image. We claim no ownership. You grant us a limited licence to process it solely to deliver the service.

Generated Images are your property, subject to OpenAI policy: you may use them commercially but must comply with applicable laws (e.g. no biometric tracking or defamation).

6. Prohibited Uses

You must not use WhateverGPT to create or distribute:

• Child sexual abuse material, non-consensual intimate images, terrorist content
• Anything that infringes third-party IP or violates data-protection law
• Content designed to harass, defame, or mislead

We may suspend or delete accounts that violate these rules.

7. Intellectual Property (ours)

All site code, logos, and brand elements are © 2025 WhateverGPT XYZ Ltd or its licensors. You may not reverse-engineer, decompile, or resell the service.

8. Third-Party Services

The service uses OpenAI, Supabase, Google, and Stripe. Their terms apply in addition to ours. We are not responsible for their acts or omissions.

9. Availability & Modification

We strive for 99 % uptime but the service is provided "as is". We may modify features or suspend the platform for maintenance with reasonable notice where practicable.

10. Termination

You may delete your account at any time. We may terminate or suspend your account immediately if you breach these Terms. On termination, unused credits are forfeited.

11. Disclaimers

AI outputs can be unpredictable. We do not guarantee accuracy, suitability, or legality of Generated Images. Use them at your own risk.

12. Limitation of Liability

Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot be limited under law. Subject to that, our total liability in any 12-month period is capped at the greater of £100 or the amount you paid in that period.

13. Indemnity

You agree to indemnify us against claims arising from your breach of these Terms or misuse of the service.

14. Governing Law & Disputes

These Terms are governed by English law. The courts of England and Wales have exclusive jurisdiction, but if you are a consumer resident elsewhere in the UK you may bring proceedings in your local courts.

15. Changes to Terms

We may update these Terms from time to time. We'll notify you by email or in-app at least 14 days before changes take effect. Continued use after that period constitutes acceptance.
